Terms of Service

These Terms are a binding agreement between you and EDIT: your legal name or company name ("Create&Scale", "we", "us") governing your purchase and use of the Create&Scale course, the Create&Scale Discord community, and this website.

By purchasing or using Create&Scale you agree to these Terms. If you do not agree, do not purchase.

1. What you are buying

Create&Scale is a digital educational product. A single purchase gives you:

• unlimited access to the Create&Scale course for as long as we operate it, including material added later;
• access to the paid Create&Scale Discord community and to direct mentorship from Daive within that community.

Access is personal to you. It is not transferable, shareable, or resellable.

2. All sales are final — no refunds

You receive the complete product the moment your payment clears — every module and immediate entry to the Discord. There is nothing to return, and access cannot be un-delivered. Please watch the free video in full and read these Terms before you buy.

Statutory exception. If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, you have a statutory right to withdraw from your purchase within 14 days. We honour that right where it applies by law. This is the only circumstance in which a refund is issued.

Chargebacks. Initiating a chargeback or payment dispute outside the statutory exception above is a breach of these Terms. We will supply our payment processor with your access logs and these Terms as evidence, and your access to the course and the Discord will be terminated immediately and permanently with no refund.

3. Payment and access

Payments are processed by Whop. Your purchase is also subject to Whop's own buyer terms, and payment disputes at the payment layer are handled by Whop directly.

You access the course by logging in with the same Whop account you purchased with. We identify you by that account. If you lose access to your Whop account, recovering it is between you and Whop — we cannot grant access to a different account without evidence that the purchase was yours.

Prices are in EDIT: USD and are shown before purchase. We may change the price at any time; changes do not affect purchases already made.

4. Licence and intellectual property

All course material — videos, written lessons, templates, scripts, prompts, and anything shared in the paid Discord — is our property or is licensed to us, and is protected by copyright.

You receive a limited, personal, non-exclusive, non-transferable licence to view and use the material for your own business. You may use the templates, scripts and prompts in your own commercial work.

You may not:

• share, resell, sublicense, republish, or redistribute any part of the material;
• share your login, screen-record, download and circulate, or otherwise give access to anyone else;
• use the material to build or market a competing course, cohort, or coaching programme;
• use the material to train a machine-learning model.

Breach of this section terminates your access immediately without refund, and we reserve all other legal remedies.

5. The Discord community

Membership in the paid Discord is part of what you buy and is subject to these Terms and to Discord's own terms of service. In the community you must not:

• harass, threaten, demean, or discriminate against any member;
• post spam, scams, unsolicited promotion, or affiliate links;
• share other members' private information or leak private conversations outside the server;
• share paid material with non-members.

We may remove any member for conduct that damages the community, at our discretion and without refund.

Mentorship inside the Discord is guidance, not a managed service. We answer questions and review work; we do not run your business, guarantee response times, or act on your behalf.

6. No guarantee of results

Any figures, examples, or case studies shown are illustrative of what has been possible, not what you should expect. Create&Scale is educational content only. It is not financial, legal, tax, investment, or professional advice, and we are not your advisor, agent, employer, or business partner. You are solely responsible for your own business decisions and for complying with the laws and tax obligations that apply to you.

7. Availability and changes

We aim to keep the course and community available continuously but do not guarantee uninterrupted access. We may update, restructure, add to, or remove course material at any time, and we may discontinue the product entirely — in which case we will give reasonable notice where practical. None of this entitles you to a refund.

We may amend these Terms. The current version is always at this URL with the date it was last updated. Continued use after a change means you accept the amended Terms.

8. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase. By buying you confirm that you are.

9. Termination

We may suspend or terminate your access immediately, without refund, if you breach these Terms — including sharing access, redistributing material, initiating a chargeback outside the statutory exception, or conduct that harms the community. You may stop using the product at any time; no refund follows.

10. Disclaimers and limitation of liability

The product is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to Create&Scale is limited to the amount you actually paid us. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business, or lost data, however caused.

Nothing here excludes liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence. If you are a consumer, your statutory rights are unaffected.

11. Indemnity

You agree to indemnify us against any claim, loss, liability, or expense arising from your breach of these Terms, your misuse of the material, or your own business activities.

12. Privacy

Our handling of your personal data is described in our Privacy Policy.

13. Governing law

These Terms are governed by the laws of EDIT: your state / country, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, without regard to conflict-of-laws rules.

14. General

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and the Earnings Disclaimer, are the entire agreement between us regarding Create&Scale.
